➥ Introduction


HereSpa, LLC, a Georgia Limited Liability company, (“Company” or “We” or “Us” or “Our”), respects your (“you”, “your”, and “user”) privacy and we are committed to protecting it through our compliance with this Privacy Policy (“Policy”).

This Policy describes the types of information we may collect from you, or that you may provide, when you visit any of our websites: www.HereSpa.com, via our mobile applications, or through social media interactions (collectively our “Portal”). This Policy describes our practices for collecting, storing, using, maintaining, protecting, and disclosing that information in the United States. This Privacy Policy applies only to users residing in the United States. We comply with applicable U.S. privacy laws and currently do not offer services outside the United States.

You are accessing and using our Portal to review our products and services and potentially to exchange information to schedule in-home beauty and personal care services that will be provided strictly by independent contractors and not directly by Us (“Services”). Thus, it is your intention by using the Portal to receive such information from us and from our third-party service providers who offer such Services.

We expect you to read this Policy carefully to understand our policies and practices as stated herein before directly providing any information to us and scheduling Services. If you do not agree with our Policy, your choice is not to use our Portal. By accessing or using this Portal, you agree to this Policy. This Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Portal after we make changes is deemed to be your acceptance of those changes.

This Policy applies to information we collect:(1) on this Portal; (2) in email, text, and other electronic messages between you and this Portal; (3) through mobile and desktop applications and forms you download from this Portal, which provide dedicated non-browser-based interaction between you and this Portal, and (4) when you interact with our advertising on third-party websites and services, if those applications or advertising include links to this Policy.

This Policy does not apply to information already known to us or collected offline or through any other means not explicitly mentioned in this Policy. Any involvement of a minor in our services requires explicit consent and presence of a parent or guardian.


This Policy is supplemental to our Terms and Conditions. If customer chooses use the Portal or to subscribe to ABC's services, customer's action is hereby deemed acceptance of Company practices described in this policy statement. Any dispute over privacy between customer and Company is subject to the provisions of this notice and to Company's Terms of Use and Conditions Agreement which is hereby incorporated herein and which can be read at https://herespa.com/termsandconditions.




➥ Information We Collect About You and How We Collect It


We collect several types of information from and about users of our Portal, including information:

  • By which you may be personally identified, such as your name, e-mail address, address and postal zip code, and telephone or mobile number (“personal information”).
  • About your internet connection, the equipment you use to access our Portal, and your usage of the Portal.
  • Chat Rooms, Forums and Bulletin Boards: If user participates in a Company chat room, discussion forum, or posts messages to a Company bulletin board, customer should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside Company, who have access to that chat room, forum or bulletin board. Some individual Company chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Also, participant's expressed opinion is his or her own and should not be considered as reflecting the opinion of Company.

We collect this information:

  • Directly from you on the Portal when you voluntarily provide it to us by filling in applications and forms or requesting more information on the Portal, when you report a problem, your correspondence, and your search queries.
  • Automatically as you navigate through the Portal. Information collected automatically may include usage details, IP addresses, your computer and internet connection, operating system, browser type, and information collected through cookies, web beacons, and other tracking technologies. The information we collect automatically is either statistical data or tracking information that does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Portal and to deliver a better and more personalized service, including by enabling us to:
    • Estimate our audience size and usage patterns.
    • Store information about your preferences, allowing us to customize our Portal according to your individual interests.
    • Speed up our Services.
    • Recognize you when you return to our Portal.
  • We share encrypted website and marketing analytics data with third-party service providers like Google, Meta, and Microsoft to enhance our services and user experience, ensuring that these providers adhere strictly to our privacy directives and their privacy policies. These providers are required to use this data in accordance with our directives and their own privacy policies.



➥Automatic Data Collection Technologies Used


The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Portal. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Portal.
  • Web Beacons. Pages of the Portal and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email, and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity.)



➥How We Use and Disclose Your Information


We use or disclose information that we collect about you or that you provide to us, including any personal information:

  • To present our Portal and its contents to you.
  • To provide you directly, or through our third-party partners, via email, text or phone calls, with Services that you request from third-party service providers though us.
  • To automatically send a copy of the web page submission form and other information you provide to our third-party service providers that provide in-home beauty and personal care services. We only disclose such information to third parties who are bound by contractual obligations or applicable laws, rules, and regulations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To notify you about changes to our Portal or any products or services we offer or provide though it.
  • To disclose aggregated information about our users and information that does not identify any individual without restriction.
  • To a buyer or other successor in the event of a sale or merger of our business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Portal users is among the assets transferred.
  • Photos and videos to confirm HereSpa Services.
  • To satisfy any other purpose with your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms and Conditions.



➥Your Personal Information

By providing your contact information on the Portal, you agree to receive communications including e-mails, calls, text messages, and pre-recorded messages from us and our third-party service providers regarding in-home beauty and personal care services. You understand that your wireless carrier’s standard message and data rates apply. We only collect the minimum amount of personal information necessary to fulfill the purpose of your interaction with us. We do not sell your information to third-parties other than as contemplated within this policy and your use of our website. If you do not want us to use your information in this way, please do not submit your personal information on our Portal. You may also consent to a Service Provider and/or HereSpa taking photos or videos before, during, and at the conclusion of rendering Services to confirm that such Services were performed or for promotional use. These digital contents, whether they show the face of the individual receiving the service, the place of service, or anything else in the background, may be used for confirming services rendered and included in our provider's portfolio or used in future marketing materials. Customers have the right to request the removal of any such digital content by sending a written request as set forth in “Accessing and Correcting Your Information” below.

We retain personal information for periods necessary to fulfill the services requested and for other legitimate legal or business purposes, such as complying with our legal obligations, resolving disputes, and enforcing our agreements. These might include retention periods mandated by law, contract, or similar obligations applicable to our business operations; for preserving, resolving, defending, or enforcing our legal/contractual rights; or needed to maintain adequate and accurate business and financial records. ➥Choices About How We Use and Disclose Your Information


We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • If you no longer want us to share your personal information with our third-party service providers for purposes of contacting you with regard to Services, you can opt-out by sending us an email with your request to support@herespa.com.

➥Accessing and Correcting Your Information


You can review and change your personal information by logging into the Portal and visiting your account profile page, if applicable, or by sending us an email with your request toprivacy@herespa.com.

We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

You have several additional rights concerning your personal data, including the right to request data portability, object to processing, and request the deletion of your personal data under certain circumstances. We have implemented reasonable and appropriate measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We regularly review and update our security practices to enhance the protection of your personal information, ensuring compliance with industry best practices and relevant regulations. These reviews are conducted on an annual basis, or more frequently in response to significant regulatory or operational changes. We ensure that our incident response plan is robust and capable of minimizing the impact of potential security breaches, thereby protecting our users' information. All information you provide to us is stored on secure servers behind firewalls. We maintain an incident response plan and will notify affected users in compliance with applicable law in the event of a data breach.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Portal, if applicable, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Additionally, any third-party service provider that you come into contact with via our Portal does NOT have access to your payment or other personal information other than the limited information necessary for you to interact with the third-party service provider. DO NOT provide your personal or financial information to any third-party service provider, and only provide such information to Us via our Portal.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Portal. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Portal.

Links to Other Web Sites. Our Portal may contain links to other web sites. Company is not responsible for the privacy practices or the content of those other websites.

Mergers and Acquisitions. Circumstances may arise where for business reasons, Company decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is Company's practice to seek appropriate protection for information in these types of transactions.

Agents. Company employs or engages other companies and individuals to perform business functions on behalf of Company. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.

Affiliated Businesses. Company works closely with affiliated businesses operating web site stores, providing services or selling products on each other's Web sites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.

No Liability for Acts of Third Parties. Company will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Company shall not be liable for unauthorized disclosure of personal information due to no fault of Company including, but not limited to, errors in transmission and unauthorized acts of [ABC staff and/or third parties].

Your California Privacy Rights. Under the California Consumer Privacy Act (CCPA), California residents may request certain information about our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please write to:privacy@herespa.com. Within 30 days of receiving such a request, ABC will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. ABC reserves its right not to respond to requests submitted other than to the address specified in this paragraph. California's privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes. Furthermore, under the California Consumer Privacy Act (CCPA), California residents have the right to request access to their personal data, request deletion of their data, and opt-out of the sale of their personal information. We are committed to fully enabling the rights provided under the CCPA and have established procedures to respond to requests from California residents in a timely manner.

All non-public user data is stored in an encrypted format, and we adhere to industry best practices to secure your data against unauthorized access and breaches.
